ONLINE STORE TERMS

By agreeing to these Terms of Trade and/or Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

ORDERS

1. To submit an order for products (order), you must:

a) Create an account with vēr वेर on this website by registering your details and creating a  username and password; and
b) Complete and submit the online order through your vēr वेर account.
c) Alternatively you may also complete and submit the online order as a guest.

2. vēr वेर reserves the right to refuse any order. In such cases, vēr वेर will notify you as soon as reasonably practicable and refund payment in full.

3. All products ordered are for personal use and gifting only. They must not be resold in any form or any place; vēr वेर reserves the right to take legal action against unauthorized and unofficial sale of goods.

PRICES AND PAYMENT

1. All prices on the website are in New Zealand dollars and are inclusive of GST. Prices are subject to change without notice.

2. The amount payable to vēr वेर for an order (order amount) will be the total of the following amounts:

a) The sum of the price of each product ordered as indicated on the website at the time of submitting the order (Product Subtotal);
b) The cost of delivery determined in accordance with Delivery stated above, and
c) The sum of any other fees which vēr वेर levies from time to time and which you have agreed to pay by providing your electronic consent (e.g. subscription fees).

3. Where the order is to be delivered to an International address, the amount of GST will be deducted from the price of each Product ordered.

4. You must pay the order amount by credit card at the time of submitting the order. vēr वेर accepts Visa, Mastercard, or American Express.

5. Where the order is to be delivered to an International address, you may need to pay customs charges and/or duty fees as levied by your local government in addition to the order amount. vēr वेर is unable to provide advice on these charges.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. GST

1. Where vēr वेर makes a Taxable Supply to you under or in connection with these Terms of Trade or in connection with any matter or thing occurring under these Terms of Trade and the consideration otherwise payable for the Taxable Supply does not include GST, vēr वेर will be entitled, in addition to any other consideration recoverable in respect of the Taxable Supply, to recover from you the amount of any GST on the Taxable Supply.

2. In these Terms of Trade, ‘GST’ means the tax payable on Taxable Supplies under the GST Legislation, ‘GST Legislation’ means the Goods and Services Tax Act 1985 and any related Act imposing such tax or legislation that is enacted to validate, recapture or recoup such tax and ‘Taxable Supply’ has the meaning given to it in the GST Legislation..

DELIVERY

1. Where the order is to be delivered to a New Zealand address, vēr वेर will:

a) Use reasonable endeavors to deliver the order within 10 working days (Monday-Friday excluding official public holidays) from the date the order was submitted by you; and
b) Send the order by courier or by New Zealand Post where the order is to be delivered to a street address.

2. Where the order is to be delivered to an International address, vēr वेर will:

a) Use reasonable endeavors to deliver the order within 20 working days from the date the order was submitted by you; and
b) Send the order by registered mail.

3. You will be required to sign for all deliveries made by registered mail and couriers.

4. vēr वेर is not responsible for delays caused by adverse weather conditions or the customs clearance process.

5. vēr वेर is not liable for return shipping fees or fees to resend a shipment if our carrier is unable to deliver your order due to an incorrect address supplied by you, your refusal to pay duties, multiple failed attempts to reach you at point of delivery or otherwise. All shipping fees connected to returned products due to unsuccessful delivery are your responsibility.

LIABILITY

1. Without limiting vēr वेर ’s legal rights arising from any failure by you to make a payment in accordance with these Terms of Trade, vēr वेर reserves the right, in its absolute discretion, to take any of the following actions against you if you fail to make such a payment :

a) withhold supply and dispose of the products requested in the order, and/or
b) refuse to deal further with you, and vēr वेर will not be liable to you for any loss or damage directly or indirectly resulting from any such action.

2. To the fullest extent permitted by law, the products are sold and information is rendered to you on the understanding that you have sole responsibility for determining the suitability of the products for the purposes for which you intend to use them.

3. Subject to the following “No Warranty” clauses and to the fullest extent permitted by law, the liability of vēr वेर for any loss or damage suffered by you as a result of vēr वेर breaching its obligations under these Terms of Trade or other tortious duty (including arising by reason of defects in the products) is limited to a refund or replacement of the relevant products.

NO WARRANTY

1. Subject to the following clauses and to the fullest extent permitted by law, vēr वेर gives no warranty in respect of the products.

2. For consumers the products come with non-excludable warranties and guarantees under consumer protection legislation, such as that vēr वेर is the rightful owner, the products are reasonably fit for their usual purpose, are of acceptable quality, and match any description or sample. vēr वेर breaches any of these non-excludable warranties or guarantees, you are entitled, at your option, to a refund or replacement of the relevant products, and to compensation for any reasonable foreseeable loss.

3. You may also have express rights of action against vēr वेर under consumer protection legislation if vēr वेर supplied defective products to you that cause you injury, loss or damage.

REFUNDS AND RETURNS POLICY

We understand that skincare can be complicated, and we want you to feel confident with your purchases. As with all skincare products, your skin will take approximately two weeks to naturally adapt. Please be patient with your skin journey, as we ask that you wait the full two weeks to see the transformative results of our products. However, due to the nature of organic and natural skincare, any opened skincare products are final sale and not eligible for returns or exchanges due to cross contamination and hygiene considerations.

We honour a 14 day return policy provided that items purchased are returned in the same unopened condition they were received in and are in their original packaging. Please note, all shipping costs are non-refundable and will be the responsibility of the customer. To start a return, you can contact us on info@vertheritual.com with the reason for the return. We'll send you instructions on how and where to send your package. Items sent back to us without requesting a return will not be accepted. Upon receiving and inspecting your return, we will issue a refund to your original form of payment within 72 hours.

We are more than happy to replace or refund any of our products that are damaged in transit or arrival, and if your product is incorrect or faulty. Please contact us within 3 days of receiving your order and ensure to record any information or proof of damage/fault, as any complimentary resolutions will not be granted after this period of time.

Only items purchased on our website www.vertheritual.com can be returned for refund or exchange if damaged, incorrect or faulty. Items purchased at any of our stockists must be returned to their original point of purchase.

Please retain your postal receipt from the provider until you are certain your parcel has been safely received by vēr वेर. We may need to see this if we fail to receive your package.

We will do our best to process returns within 3 business days of receiving your return, and a reimbursement will be issued in the original form of payment.
